Part II: Disclaimer
7. General Information Only
Content on the Site is provided for general informational and marketing purposes. It is not engineering advice, safety advice, radiological health advice, regulatory guidance, legal advice, or a recommendation for any specific installation or application. Do not act on Site content without consulting qualified professionals and, where relevant, Global Gauge engineering personnel regarding your specific circumstances.
8. Product Specifications Are Not Warranties
Specifications, accuracy figures, measurement ranges, throughput values, dimensions, materials, and performance claims on the Site are representative values based on typical configurations and test conditions. They are subject to change without notice and do not constitute a warranty, express or implied.
Actual performance of any measurement system depends on factors including mill and line conditions, product alloy and geometry, temperature, vibration, ambient conditions, source strength and age, mounting and alignment, calibration practice, maintenance, and operator training. The only binding description of a product's performance is the specification set out in the written quotation, purchase agreement, and acceptance test documentation for that specific system.
9. Radiation Safety and Regulatory Responsibility
Global Gauge products incorporate x-ray generating devices, and our service, upgrade, and source recovery activities involve legacy gauges containing sealed radioactive sources. These categories are regulated differently in the United States:
- X-ray generating devices are radiation producing machines. They are registered and regulated by state radiation control programs, which in Ohio is the Ohio Department of Health. At the manufacturing level they are also subject to the federal electronic product radiation control requirements administered by the U.S. Food and Drug Administration, Center for Devices and Radiological Health, under 21 C.F.R. Parts 1000 through 1005, and, where the product type falls within their scope, to the performance standards in 21 C.F.R. Part 1020.
- Sealed radioactive sources in legacy gauges are typically byproduct material. Their possession, use, transfer, storage, and disposal require a license from the U.S. Nuclear Regulatory Commission or, in an Agreement State, from that state's radiation control agency under an agreement made pursuant to Section 274(b) of the Atomic Energy Act. Ohio is an Agreement State, and radioactive material licensing in Ohio is administered by the Ohio Department of Health.
- Transportation of radioactive material in commerce is separately regulated by the U.S. Department of Transportation under 49 C.F.R. Parts 171 through 180, and packaging by the U.S. Nuclear Regulatory Commission under 10 C.F.R. Part 71.
Outside the United States, equivalent national authorities apply.
Nothing on the Site relieves any purchaser, owner, or operator of its obligation to obtain and maintain all required licenses, registrations, and permits, to appoint a qualified Radiation Safety Officer where required, to train personnel, to perform required surveys, leak tests, and inventories, and to comply with all applicable radiation safety regulations. Site content is not a substitute for the applicable license conditions, regulatory requirements, or the safety and operating manuals supplied with the equipment.
10. Accuracy and Currency
We make reasonable efforts to keep Site content accurate and current, but we do not warrant that it is complete, accurate, current, or free of error or omission. Content may become outdated, and we are under no obligation to update it. To the fullest extent permitted by law, Global Gauge disclaims all liability for any error, omission, or reliance on Site content.
11. Third-Party Content and Links
The Site links to third-party websites, including those of our independent international representatives LGE Engineering srl (Genoa, Italy) and ZEITDC (Zhuozhou, Hebei Province, People's Republic of China), and to social media platforms. We do not control those sites and are not responsible for their content, accuracy, availability, security, or privacy practices. A link does not constitute an endorsement. Your use of any linked site is at your own risk and subject to that site's terms.
12. Certifications
References on the Site to ISO 9001:2015 certification of our Quality Management System and ISO/IEC 17025:2017 accreditation of our Standards Calibration Laboratory describe the scope stated in the applicable certificates. Certification and accreditation are subject to periodic assessment and to the scope, conditions, and validity periods set out on the certificates themselves, which control in the event of any inconsistency with Site content.
13. Forward-Looking Statements
Statements on the Site about future products, capabilities, capacity, roadmap, or business plans reflect current expectations as of the date published. They involve risks and uncertainties, and actual results may differ. We undertake no obligation to update them.
14. Export Control
Products, technical data, and software described on the Site may be subject to United States export control laws, including the Export Administration Regulations, and to sanctions administered by the U.S. Department of the Treasury. Export or import of byproduct material, including sealed radioactive sources, may additionally require authorization from the U.S. Nuclear Regulatory Commission under 10 C.F.R. Part 110. Export, re-export, or transfer may require prior authorization from the United States government. Nothing on the Site constitutes authorization to export.
15. No Professional Relationship
Viewing the Site, submitting a form, or corresponding with us does not create any engineering, consulting, fiduciary, or contractual relationship. Such a relationship arises only under a signed written agreement or an accepted written quotation.
16. Limitation of Liability
Your use of the Site is governed by our Terms of Use, including the disclaimer of warranties and the limitation of liability set out there. Those provisions apply to your use of the Site and its content only.
For the avoidance of doubt, nothing in this notice or in our Terms of Use limits, waives, or disclaims any warranty, remedy, or liability arising under a written quotation, purchase agreement, or service agreement between Global Gauge Corporation and a customer, or any liability that cannot be limited or excluded under applicable law, including liability for personal injury.
